I am writing to you to express my concern about the unfairness of the use of photo radar devices as a method for issuing speeding tickets. I do believe that drivers who break the law should face the consequences of their actions. Nevertheless, I believe that photo radar violates important constitutional rights, not to mention my concerns about its accuracy.

First, a photo radar machine is not a human being. Allowing a photo radar machine to issue tickets violates my right to face my accuser.

Second, the law forces the owner of the photographed vehicle to give up the name of the person who was driving the vehicle at the time it was photographed. If the owner was the driver, this violates the owner's constitutional right against self-incrimination. If the owner was not the driver, this forces the owner to incriminate a friend or family member.

Finally, I believe the general public is simply more comfortable dealing with a police officer than a machine. Being able to discuss a violation with a police officer is much more personal and understandable as opposed to receiving a ticket in the mail. As a taxpayer, I am asking you to eliminate photo radar in our state and if necessary, hire more police to handle traffic violations. Using photo radar is not a prudent or fair use of taxpayer dollars, and it has certainly caused many to question the constitutionality of its use.

I am interested in protecting my rights and the rights of others when it comes to the use of photo radar.

This issue is very important to me and many of your constituents. Please acknowledge this message and let me know your position on this matter.
