Sec. 14-37. Witness fees. |
(a) A defendant may have subpoenas issued for and served upon witnesses upon deposit with the clerk of the county court of witness fees of one dollar and fifty cents ($1.50) for each witness; but if a defendant shall make a satisfactory affidavit and proof that the defendant is unable to pay such witness fees, then the defendant may have subpoenas issued for and served upon such persons as the defendant shall desire to have testify without advancing witness fees therefor. |
(b) Every witness subpoenaed as herein provided, who makes claim therefor in writing at the time of the appearance except an officer or employee of the city, shall be entitled to receive a witness fee of one dollar and fifty cents ($1.50) for each session of court attended under such subpoena or pursuant to the orders of the court to be paid out of the fund appropriated for the operation of the county court upon voucher approved by the clerk of the court. If any defendant is found guilty, the fees for subpoenaed witnesses appearing in the case shall be added by the judge to the fine which, otherwise, would have been imposed against the defendant. |
(c) Every reserve police officer subpoenaed to appear in court to testify for the City and County of Denver who indeed testifies in court and makes a claim thereof in writing at the time of the appearance shall be entitled to receive a thirty dollars ($30.00) an hour witness fee for a two-hour minimum or the actual time present in court, whichever is greater. |
