Dear Elected Official:
I am writing to you to seek an amendment to CRS 18-4-412 relating to protection of medical information and medical records. The scope of this statute should be expanded to prohibit the use of information obtained in the course of processing a first party claim for any purpose other than to process that specific claim. The scope should also be expanded to prohibit contact between insurance companies (and insurance claims adjusters within the same company) to discuss any person insured by either of them unless the prior written authorization of the person is obtained. I also believe it is appropriate to impose stricter penalties for an adjuster who violates this law.
I am aware of a situation in Colorado involving Travelers (representing the guilty driver) and Country Companies (supposedly representing the innocent victim, but actually representing itself) in which an unauthorized conversation took place between them, information was exchanged (although to what extent is unknown because of the insurance companies' cover up), and when confronted, both companies protested that "no unauthorized" issues were covered. This type of adjuster-to-adjuster sharing of information without consent is unacceptable.
To ensure that my privacy is protected, immediate legislative action is needed to eliminate the possibility of insurance companies misusing information and contacting each other in any way to discuss me or my family, without my written authorization.
When I make a claim for benefits under my own insurance policy, benefits I have paid for by dutiful and regular payment of expensive premiums, I have no choice but to allow my insurance company to obtain information about me and my injuries in order to would process the claim. I consider that information confidential and I expect my insurance company to maintain the confidentiality of that information. Claims adjusters should NOT have the right to disclose private information about me, my family or my friends without written authorization.
I pay my premiums to protect myself and my family and I believe it is only fair that I receive mutual respect and fairness from my insurance company with regard to access to any information about me and my family. Please acknowledge this message, and please let me know what your position is on this very serious matter. This is very important to me and to many of your other constituents.
