Dear Elected Official:

The insurance industry continues to seek ways to eliminate or lower coverage to its insureds, while simultaneously raising premiums.

I am writing to you to express my concern about the recent proposed regulations from the Internal Revenue Service, the Pension and Welfare Benefits Administration and the Health Care Financing Administration. I understand that these agencies have proposed regulations that would allow employers, labor unions and group health plans to deny benefits coverage for injuries resulting from legal recreational activity.

While the new proposals state than an individual employee cannot be denied health-care coverage based on participation in recreational activities, they permit employers, unions and health insurers to deny benefits coverage for injuries sustained in connection with such recreational activities. This is an egregious attempt by regulators to double-talk their way into eliminating coverage.

As you are aware, physical activity is a vital part of long-term health viability. Discouraging this activity due to the fear of potential non-coverage deters the long-term benefit of optimal health and wellness. It is not appropriate to indirectly ban legal recreational activity to those of us who depend on it for stress release, quality time spent with our friends and family, and activity that we encourage our children to participate and excel in during their formative years.

I am asking you as my elected official to address this matter and assure your constituents that we can continue to have confidence that the insurance companies will cover claims made for injuries sustained during recreational activity and that disclosure of any such legal activity will not be required or monitored by insurance companies or any state or federal agencies. Please acknowledge this message and let me know your position on this matter.
